FTC — undisclosed or deceptive use of AI in ads is unlawful
There is no FTC 'made with AI' label, but its rules apply to AI with full force and no exemption. March 2025 staff guidance: if AI generates or substantially modifies advertising content, that use should be disclosed. AI-generated reviews/testimonials are treated as fake reviews and are prohibited regardless of any disclaimer (Fake Reviews Rule, 16 CFR Part 465). A synthetic endorser needs both a sponsorship disclosure (#ad) and a clear notice that the endorser is AI-generated. Penalties reach $53,088 per violation (2026); the FTC opened a dedicated AI enforcement unit in Jan 2026.
